By accessing or using HostDeck Store ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services. These Terms apply to all visitors, users and customers of the site and our VPS hosting services.

2. Eligibility

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use our services. By using our services, you represent and warrant that you meet this requirement and that your use of the services complies with all applicable laws and regulations.

3. Account and Registration

To place an order you may be required to provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us promptly of any unauthorized use of your account.

4. Orders and Pricing

All prices are listed in US dollars (USD) and are subject to change without notice. When you place an order, you are entering into a binding agreement to purchase the selected VPS service. The price shown at the time of order is the price that will be charged, unless otherwise stated. Taxes, where applicable, are calculated at checkout.

5. Payment Terms

Payment is due at the time of order. Available payment methods are displayed during checkout. We reserve the right to refuse or cancel any order if payment is not successfully completed, or if we have a reasonable belief that the order is fraudulent or violates these Terms.

6. Service Provision

After successful order processing, your VPS is provisioned and you receive the relevant configuration and setup information according to the selected service. We use reasonable efforts to provide the service as described, but we do not guarantee uninterrupted or error-free service.

7. Acceptable Use

You agree to use our services only for lawful purposes and in accordance with our Acceptable Use Policy. You are responsible for all content you host and all activity on your VPS. Prohibited activities include, but are not limited to, illegal activity, malware, phishing, fraud, unauthorized access, network abuse, spam and copyright infringement.

8. Intellectual Property

All content on this site, including text, graphics, logos and software, is the property of HostDeck Store or its licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute or create derivative works without our prior written consent.

9. Prohibited Use

You may not use our services to: (a) violate any applicable law or regulation; (b) infringe the rights of others; (c) transmit malicious code; (d) conduct spam or unsolicited bulk communications; (e) attempt to gain unauthorized access to our systems or other users' systems; or (f) engage in any activity that could damage, disable or impair our services.

10. User Content

You retain ownership of the content you host on your VPS. You are solely responsible for that content and for ensuring it complies with applicable laws. We are not liable for any content hosted by our customers, except where required by law.

11. Disclaimers and Limitation of Liability

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose and non-infringement. To the maximum extent permitted by law, HostDeck Store shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or use, arising from your use of our services.

12. Indemnification

You agree to indemnify and hold harmless HostDeck Store, its officers, employees and agents from any claims, damages, losses and expenses, including reasonable legal fees, arising from your use of our services or your violation of these Terms.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms shall be resolved in accordance with the laws applicable to your place of residence, to the extent permitted by law.

14. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the site or by other means. Your continued use of our services after changes take effect constitutes acceptance of the revised Terms.
